TOWN AND COUNTRY PLANNING (GENERAL PERMITTED DEVELOPMENT) (ENGLAND) ORDER 2015 (AS AMENDED)

LAND AT LADY HERBERT'S GARDEN AND THE BURGES CONSERVATION AREA

DIRECTION MADE UNDER ARTICLE 4(1) OF THE GENERAL PERMITTED DEVELOPMENT ORDER 2015 (AS AMENDED), RESTRICTING PERMITTED DEVELOPMENT TO WHICH ARTICLE 6 APPLIES

WHEREAS Coventry City Council (“the Council”) being the appropriate local planning authority within the meaning of Article 4(5) of the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended) (“the Order”) are satisfied that it is expedient that development of the description(s) set out in the Second Schedule below should not be carried out to the properties identified in the First Schedule and shown on the map in the Third Schedule below being land comprised in the Lady Herbert's Garden and Burges Conservation Area, as shown edged in red on the attached plan; unless planning permission is granted on an application made under Part III of the Town and Country Planning Act 1990 (as amended).

For the avoidance of doubt, the Council is satisfied that the Direction is necessary to protect the amenity of the Conservation Area and in the interests of good planning.

NOW THEREFORE THE SAID Council in pursuance of the power conferred on them by Article 4(1) of the Order hereby direct that the permission granted by Article 3 of the Order shall not apply to development within the Lady Herbert's Garden and Burges Conservation Area (as more particularly defined in the First Schedule) of the description(s) set out in the Second Schedule below, unless planning permission is granted on an application made under Part III of the Town and Country Planning Act 1990 (as amended).

THIS DIRECTION is made under Article 4(1) of the Order and, in accordance with Schedule 3, paragraph 2(6), comes into force with immediate effect and shall remain in force until 8th day of January 2026 (being six months from the date of the direction) and shall then expire unless it has been confirmed by the appropriate local planning authority in accordance with paragraph 1(9) and 1(10) of schedule 3 of the Order before the end of the six month period.

FIRST SCHEDULE

The following properties ARE SUBJECT to this Direction:

• Burges: all properties

• Chauntry Place: all properties

• Hales Street: all properties

• Palmer Lane: all properties

SECOND SCHEDULE

Schedule 2, Part 1 Class B of the Order:

The enlargement of a dwellinghouse consisting of an addition or alteration to its roof.

Schedule 2, Part 1 Class C of the Order:

Any other alteration to the roof of a dwellinghouse.

Schedule 2, Part 1 Class D of the Order:

The erection or construction of a porch outside any external door of a dwellinghouse.

Schedule 2, Part 1 Class H of the Order:

The installation, alteration, or replacement of a microwave antenna on a dwellinghouse or within the curtilage of a dwellinghouse.

Schedule 2, Part 2 Class A of the Order:

The erection, construction, maintenance, improvement or alteration of a gate, fence, wall or other means of enclosure.

Schedule 2, Part 2 Class C of the Order:

The painting of the exterior of any building or work.

Schedule 2, Part 2 Class D of the Order:

The installation, alteration or replacement, within an area lawfully used for off-street parking, of an electrical outlet mounted on a wall for recharging electric vehicles.

Schedule 2, Part 2 Class E of the Order:

The installation, alteration or replacement, within an area lawfully used for off-street parking, of an upstand with an electrical outlet mounted on it for recharging electric vehicles, and the installation, alteration or replacement, at ground level within a non-domestic area lawfully used for off-street parking of equipment necessary for the operation of an upstand and a unit of equipment housing for the storage of equipment necessary .

Schedule 2, Part 2 Class F of the Order:

The installation, alteration or replacement on a building of a closed circuit television camera to be used for security purposes.

Schedule 2, Part 7 Class A of the Order:

The extension or alteration of a commercial, business or service establishment.

Schedule 2, Part 7 Class C of the Order:

Development consisting of the erection or construction of a collection facility within the curtilage of a shop.

Schedule 2, Part 7 Class D of the Order:

Development consisting of modification of a loading bay of a shop.

Schedule 2, Part 7 Class E of the Order:

The provision of hard surfaces for commercial, business or services etc premises. Schedule 2, Part 14 Class A of the Order: The installation, alteration or replacement of microgeneration solar PV or solar thermal equipment on a dwellinghouse or a block of flats; or a building situated within the curtilage of a dwellinghouse or a block of flats.

Schedule 2, Part 14 Class B of the Order:

The installation, alteration or replacement of stand-alone solar for microgeneration within the curtilage of a dwellinghouse or a block of flats.

Schedule 2, Part 14 Class C of the Order:

The installation, alteration or replacement of a microgeneration ground source heat pump within the curtilage of a dwellinghouse or a block of flats.

Schedule 2, Part 14 Class D of the Order:

The installation, alteration or replacement of a microgeneration water source heat pump within the curtilage of a dwellinghouse or a block of flats.

Schedule 2, Part 14 Class E of the Order:

The installation, alteration or replacement of a flue, forming part of a microgeneration biomass heating system, on a dwellinghouse or a block of flats.

Schedule 2, Part 14 Class F of the Order:

The installation or alteration or replacement of a flue, forming part of a microgeneration combined heat and power system, on a dwellinghouse or a block of flats.

Schedule 2, Part 14 Class G of the Order:

The installation, alteration or replacement of a microgeneration air source heat pump on a dwellinghouse or a block of flats; or within the curtilage of a dwellinghouse or a block of flats, including on a building within that curtilage.

Schedule 2, Part 14 Class H of the Order:

The installation, alteration or replacement of a microgeneration wind turbine on a detached dwellinghouse; or a detached building situated within the curtilage of a dwellinghouse or a block of flats.

Schedule 2, Part 14 Class I of the Order:

The installation, alteration or replacement of a stand-alone wind turbine or microgeneration within the curtilage of a dwellinghouse or a block of flats.

Schedule 2, Part 14 Class J of the Order:

The installation, alteration or replacement of a microgeneration solar thermal equipment on a building; microgeneration solar PV equipment on a building; or other solar PV equipment on the roof of a building, other than a dwellinghouse or a block of flats.

Schedule 2, Part 14 Class K of the Order:

The installation, alteration or replacement of stand-alone solar for microgeneration within the curtilage of a building other than a dwellinghouse or a block of flats.

Schedule 2, Part 14 Class L of the Order:

The installation, alteration or replacement of a microgeneration ground source heat pump within the curtilage of a building other than a dwellinghouse or a block of flats.

Schedule 2, Part 14 Class M of the Order:

The installation, alteration or replacement of a microgeneration water source heat pump within the curtilage of a building other than a dwellinghouse or a block of flats.

Schedule 2, Part 14 Class N of the Order:

The installation, alteration or replacement of a flue, forming part of a microgeneration biomass heating system, on a building other than a dwellinghouse or a block of flats, or a building situated within the curtilage of a dwellinghouse or a block of flats.

Schedule 2, Part 14 Class O of the Order:

The installation, alteration or replacement of a flue, forming part of a microgeneration combined heat and power system, on a building other than a dwellinghouse or a block of flats, or a building situated within the curtilage of a dwellinghouse or a block of flats.

Schedule 2, Part 14 Class OA of the Order:

The installation, alteration or replacement of a solar canopy within an area lawfully used as off-street parking other than for a dwellinghouse or a block of flats.

Schedule 2, Part 16 Class A of the Order:

Development by or on behalf of an electronic communications code system for the purpose of the operator’s electronic communications network in, on, over or under land controlled by that operator or in accordance with the electronic communications code, consisting of; the installation, alteration or replacement of any electronic communications apparatus; the use of land in an emergency for a period not exceeding 18 months to station and operate moveable electronic communications apparatus required for the replacement of unserviceable electronic communications apparatus, including the provision of moveable structures on the land for the purposes of that use, or development ancillary to radio equipment housing.

Schedule 2, Part 16 Class B of the Order:

The installation, alteration or replacement on any building or other structure of a height of 15 metres or more of a microwave antenna and any structure intended for the support of a microwave antenna.

Schedule 2, Part 16 Class C of the Order:

The installation, alteration or replacement on any building or other structure of a height of less than 15 metres of a microwave antenna.

THIRD SCHEDULE

Properties within the boundaries of the map, the designated boundary of the Lady Herbert’s Garden and Burges Conservation Area, shown on Fig 3.1 ARE SUBJECT to this direction.
