Notice is hereby given that the Secretary of State for Communities and Local Government has prepared in draft an order under section 292 of, and paragraph 88(3) of Schedule 24 to the Town and Country Planning Act 1971. He is about to make this order, and if made the order will discharge the restrictions described below to the extent that they apply to the land described below.

A copy of the order and the accompanying map may be obtained, free of charge, on application to the National Planning Casework Unit, 5 St Phillips, Colmore Row, Birmingham B3 2PW npcu@communities.gsi.gov.uk 0303 4448050, or may be inspected at reasonable hours at the Department for Communities and Local Government Offices, 5 St Phillips, Colmore Row, Birmingham B3 2PW.

Any objection to the order must be made in writing to the National Planning Casework Unit, 5 St Phillips, Colmore Row, Birmingham B3 2PW on or before 20 June 2013 and should state the title of the order, the grounds of objection and the objector’s address.

DESCRIPTION OF RESTRICTIONS AND LAND

The restrictions which the order will discharge are the conditions set out in the Second Schedule and the Third Schedule of an agreement dated 22 March 1941 made under section 34 of the Town and Country Planning Act 1932 between (1) Geoffrey St John Strutt CBE (2) Martins Bank Limited (3) The Rural District Council of Bathavon (4) The County Council of the Administrative County of Somerset restricting the development or use of the land shown outlined in red on the plan attached to the order at Schedule 2 and known as land at St Catherine’s Court, St Catherine, Bath BA1 8HA to the extent that the conditions apply to that land.
